Company charges provide security in return for a loan or as security for a debt and can be created over almost all types of property.
Part 25 of the Companies Act 2006, which came into force on 1 October 2009, requires most types of charges to be registered to ensure validity, in the event of the company creating the charge going into liquidation.
The course looks at the case law and new statutory provisions in order to provide the legal background to and issues concerning the nature of company charges and the registration regime as well as the principles for determining priorities between competing security interests in the same property.

Speaker: Gerard McCormack, Barrister (Kings Inns Dublin 1985) and Professor of Law at the University of Leeds. Gerard has published extensively in this area including 'Registration of Company Charges' (2nd edition Jordans 2005). He also contributes the relevant chapters on charges to the standard text 'Gore Brown on Companies'. |
