While most of the major lenders have signed up to the Government ‘request’ to allow borrowers a longer period of arrears before commencing possession proceedings, such periods will eventually expire. The statutory accounting requirements will then force lenders to take urgent action - 2009 promises to be a record year for possession proceedings.
There is a new protocol on mortgage possession proceedings; whether you act for lenders or borrowers you need to be up-to-date not only with the protocol but with tactics, the latest cases and also ‘court thinking’ on the subject.
