This seminar provides a thorough analysis of the key elements required to prove and/or defend a compensation claim for a defective product under both the strict liability regime in the Consumer Protection Act 1987 ("CPA"), and at common law.
Despite the passage of time since the CPA was enacted, there is still plenty to dispute or debate. Reliable authorities and practitioner textbooks are still relatively thin on the ground and the seminar will aim to equip practitioners with the arguments and analysis required to practise with confidence in this field and to engage in controversial issues of law.
The emphasis throughout will be practical, focussing on pleadings and litigation tactics, but will also cover the key authorities in this field and provide suggestions as to how those decisions can be applied to a range of cases.

As well as clinical negligence and PI work Hugh’s specialisms include product liability cases, covering items as diverse as defective farm equipment and exercise bikes to group actions on replacement hips. He has appeared in courts at all levels including the House of Lords and the ECJ. He writes regularly for legal periodicals on this subject. |
