Introduction

Chaired by Robert Bond, this virtual classroom annual conference with a panel of leading experts offers a comprehensive update as to the current hot topics in this fast-moving area.

Each session will provide a full opportunity for questions and answers.

Conference Agenda

This 5-hour online conference will cover the following:

10:00am-11:00am: Reforms to the UK Data Protection and e-Privacy Laws

Chair: Robert Bond, Robert Bond, Senior Counsel, Privacy Partnership Law

The Data Protection and Digital Information Bill is set to impact the data protection compliance regime in the UK. This presentation will analyse the likely impact.

  • Background to the changes
  • Proposed reductions in GDPR requirements and positive outcomes
  • Practicalities of removal of the need for a Record of Processing Activities and simplification of the rules on using Data Protection Impact Assessments
  • Is the role of the Senior Responsible Individual any improvement on the role of the Data Protection Officer?

Morning Break

11:10am-12:10pm: Recent Regulatory Decisions and Fines

Ian Beeby, 10 KBW

This session will cover a summary of regulatory decisions leading to fines and a similar summary of those civil claims where damages have been awarded which have been published (not all are).

It seems that many aggrieved data subjects are anticipating far higher damages awards than the courts are, in reality, prepared to grant, notwithstanding that some regulatory penalties are eye-watering.

12:10pm-1:10pm: Digital Security & Cyber Related Risks

Dr Stephen Hill, Hill Bingham Ltd

Digital technology continues to transform and disrupt the world of business, exposing organisations to both opportunities and threats. In this age of dependence on IT systems, effective IT security is a business imperative. Knowing more about the key IT risks linked to data exposure and how to manage them is important for all businesses' success now and in the future.

Richard Chambers, former IIA president, once said: ‘The technology risks we face today are increasingly complex, and a sophisticated, well-thought-out approach is required to manage them.’

This session will explore the current threats to our biggest asset - 'data' and will consider best practice in an effort to reduce the onslaught of evolving risks including security benchmarks such as cyber essentials.

Break for lunch

2:00pm-3:00pm: DSARS - The Difficulties and Direction of Travel

Emily Carter, Kingsley Napley

This session will cover:

  • Thorny Issues:
    • Proportionality of search
    • Information concerning source / recipient of personal data (CJEU Österreichische Post AG decision - February 2023)
    • Approaching third party data

    • ICO obligation to investigate (Delo v ICO - January 2023)
    • New ICO policy re publication of reprimands re DSAR failures
  • Data Protection Reform Bill

Afternoon break

3:15pm-4:15pm: Data Protection Laws Outside the UK and EU

Robert Bond, Senior Counsel, Privacy Partnership Law

The majority of countries now have some form of data protection law. It is interesting to see how much influence the GDPR has on global data protection laws.

This session will cover:

  • The history of data protection concepts
  • Common privacy principles
  • Similarities between jurisdictions
  • The US landscape.
  • International data transfers rules
  • Is there a ‘one size fits all’ opportunity?
